1. Legal information
1.1 The website www.efalia.com (hereinafter the” Site ”) and the following general conditions of use (hereinafter the” CGU ”) are published, operated and provided by Efalia, whose full contact details are available by clicking here (hereinafter” Efalia ”).
2. Objects of these General Terms of Use
2.1 These General Terms of Use (hereinafter the” CGU ”) aim to define the conditions under which the Site is made available to Users.

4. Definitions
4.1 For the purposes of these Terms of Use, capitalized terms, whether used in the singular or plural, have the following meaning:
- TERMS OF USE: refers to these General Terms of Use;
- Personal Data (s): refers to the User's personal data collected and/or processed by Efalia in the context of the use of the Site, such as, where applicable, the provision of the Services, and under the terms and conditions as defined in the Privacy Policy;
- Confidentiality Policy : refers to the privacy policy whose purpose is the conditions and methods of processing Users' Personal Data by Efalia and accessible by clicking here which is an integral part of these T&Cs;
- Efalia: refers to the company Efalia identified in the accessible legal notices by clicking here;
- Services : refers to the services offered by Efalia and described on the Site;
- User: refers to any adult and capable natural person accessing the Site, in compliance with these Terms and Conditions and for use for personal purposes, to the exclusion of any other purpose.
5. Scope, acceptance and modification of the CGU
5.1 The purpose of the CGU is to define the conditions under which Users can access the Site, and learn about the Services.
5.2 Any use of the Site automatically implies the application of these T&Cs.
5.3 As the CGU may be subject to modification, the applicable CGU are those in force and accessible on the Site, then, in case of modification, on the date of access to the Site. It is therefore up to the User to regularly review the Terms and Conditions.

Through its Site, Efalia provides Users with access to content of any kind, Service offers, graphic, multimedia, software and/or interactive content.
7. Publicity
Efalia reserves the right to broadcast advertising or promotional messages on its Site.
8. Access and availability
8.1 Access to the Site is free and free.
8.2 Efalia makes its best efforts to make its Site available 24 hours a day, 7 days a week. Given the particular nature of the Internet network, access to the Site may be interrupted or restricted at any time, in particular by a cause external to Efalia whose responsibility cannot be sought in this respect.
8.3 In addition, Efalia reserves the right to interrupt access to the Site for maintenance and/or improvement work. These interruptions will, to the extent possible of Efalia, be notified in advance to Users before any interruption.
8.4 In case of emergency, Efalia nevertheless reserves the right to partially or completely suspend access to the Site for a reasonable period of time in order to conduct any technical operation required.
8.5 These interruptions may not give rise to any compensation for the benefit of the User.
9. Responsibility and Guarantees
9.1 Guarantees
9.2.1. By accessing the Site, the User declares, guarantees and undertakes to:
- access and use the Site in good faith, in a reasonable manner, not contrary to the terms of these T&Cs;
- not to use devices or software other than those provided by Efalia intended to i) affect or attempt to affect the proper functioning of the Site ii) to extract, modify, consult, even in buffer or temporary memory, or for individual use, or for individual use, all or part of the Site;
- not to access and/or use the Site for illicit purposes and/or in order to cause damage to the reputation and/or image of Efalia and/or Users, or more generally to infringe the rights, in particular intellectual property, of Efalia and/or third parties, including Users;
- not to market access to the Site directly or indirectly;
- not to reuse or exploit all or part of the Site it contains, in particular for commercial and/or collective purposes and/or for personal purposes in a form and/or media not authorized by Efalia;
- not to reproduce or represent all or part of the Site for private purposes beyond the legal exceptions provided for, in particular by the Intellectual Property Code, or for direct or indirect marketing in particular to third parties;
- not to limit access to and use of the Site;
- ensure that the use of the Site does not affect or compromise the stability, security and quality of the Site, networks, bandwidth, or infrastructures of Efalia, other Users and/or third parties;
- not to contravene the provisions of articles 323-1 to 323-7 of the Criminal Code punishing piracy practices.

In the event of a breach of any of these obligations, without this list being exhaustive, the User is informed that Efalia will have the right to refuse or suspend him, unilaterally and without prior notification, access to all or part of the Site.
9.2 Limitation of liability
9.2.2. The User is solely responsible for the use he makes of the Site. Efalia cannot under any circumstances be held responsible in the context of proceedings brought against Users who are at the origin of non-compliant use of the Site.
9.2.3. The Site may contain hypertext links to third party websites. In particular in view of the evanescent nature of the content that may be broadcast there, Efalia cannot be held liable in the event that the content of these third party websites violates the legal and/or regulatory provisions in force.
9.2.4. Finally, Efalia cannot be held liable in the event of non-compliance with the legislation of a foreign country where the use of the Services and/or the downloads would be carried out.
9.2.5. In any event, Efalia cannot be responsible for:
i) in the event of unavailability of the Site for reasons such as the failure of the public electricity network, the failure of the cable telecommunications networks, the loss of connectivity to the Internet network due to public or private operators, in particular the User
ii) in the event of use of the Site by the User under conditions that do not comply with these Terms and Conditions and/or any malfunction of any nature whatsoever relating to the User's Terminal as well as to his Internet access connection;
iii) within the limits of the legislation in force, for any indirect damage, such as in particular the harmful consequences of an attack on image, privacy, loss of profit, data or any other loss of intangible assets, even if Efalia has been informed of the potential for such damage, which may occur.
10. Intellectual property
10.1 Copyright
The structure of the Site but also the texts, graphics, images, images, images, photographs, photographs, photographs, sounds, videos and computer applications that compose it are the property of Efalia and are protected as such by the laws in force under intellectual property.
Any representation, reproduction, adaptation or partial or total exploitation of the contents offered by the Site, by any process whatsoever, without the prior, express and written authorization of their owner, is strictly prohibited and would be likely to constitute an infringement.
10.2 Distinctive signs

Any representation and/or reproduction and/or partial or total exploitation of these distinctive signs is therefore prohibited and constitutes trademark infringement, usurpation of a company name, trade name and domain name engaging the criminal liability of its author.
10.3 Scope of license
The User acknowledges and accepts that access to the content made available by Efalia does not involve any transfer or concession of intellectual property rights (copyright in particular) and other personality rights (image rights, privacy rights) for the benefit of the User. The Site is exclusively limited to the User's private and personal use.
10.4 Hypertext links
The hypertext links accessible on the Site, to other websites and in general to any existing resources on the Internet cannot engage the responsibility of Efalia.
In this case, the User may not set up hypertext links to deep pages of the Site by any technical process intended to bypass the User's identification field or to extract all or part of the content of the Site.
The “framing” technique is prohibited, unless expressly authorized in advance by Efalia.
10.5 Databases
The User irrevocably acknowledges that the Site, including the structure and/or their order, consists of one or more databases made available to Users by Efalia as a producer of said databases within the meaning of the provisions of articles L.341-1 and following of the Intellectual Property Code.
Therefore, in accordance with the provisions of article L.342-1 of the same Code, the User is prohibited from proceeding with:
- the extraction by permanent or temporary transfer of all or a qualitatively or quantitatively substantial part of the content of one or more of the databases accessible on the Site, on another medium, by any means and in any form whatsoever, including for the purposes of use or consultation by a media and/or process (s) not authorized by Efalia;
- the reuse, by making available to the public all or a qualitatively or quantitatively substantial part of the content of one or more of the databases accessible on the Site, regardless of their form, including through a hypertext link, media and/or process (s) not authorized by Efalia;
- setting up, publishing, maintaining, updating, importing, exporting, making available to third parties, free of charge or for a fee, and participating in the above actions, of a competing database resulting from all or part of one or more of Efalia's databases;
- viewing on a screen by a process or media other than those by which Efalia intends to disclose the Site, including the structure and/or layout of the Site;
- in general, any extraction, use, storage, reproduction, reproduction, representation or conservation, direct or indirect, partial or total, including in buffer or temporary memory, qualitatively or quantitatively substantial, of the content of one or more of Efalia's databases, committed by any of the processes referred to above, is strictly prohibited, including by a medium not authorized by Efalia.

12. Various
12.1 Force Majeure
Efalia cannot be held liable if the performance of one of its obligations is prevented or delayed due to a case of force majeure as defined by article 1218 of the Civil Code.
12.2 Insurance
Efalia is insured by insurance.
12.3 Correspondence— Proof
Except as otherwise provided in these Terms of Use, correspondence exchanged between Efalia and the User is exclusively provided by email and by correspondence from the Site.
The User acknowledges and accepts that the information provided by Efalia by email and/or on the Site is authentic between him and Efalia. Elements such as the time of reception or transmission, as well as the quality of the data received, as well as the quality of the data received, shall be considered as authentic by Efalia's computerized procedures, unless written proof to the contrary is provided by the User. The scope of the proof of the information delivered on the Site is that granted to an original in the sense of a written paper document, signed in a handwritten manner.
12.4 Integrity
These CGU express all the obligations of Efalia and the User.
12.5 Partial invalidity
In the event that one or more stipulations of these T&Cs are considered null and void, deemed to be unwritten or declared as such in application of a law, regulation or following a decision of a competent court having the authority of res judicata as a last resort, the other stipulations will remain in full force and scope and will remain fully applicable, unless the invalid stipulation (s) were of a substantial nature and their disappearance would restore in question the contractual balance.
12.6 Titles
In the event of interpretation difficulties between one of the titles appearing at the top of the clauses of these Terms and Conditions, and one of the clauses, the titles will be declared non-existent.
13. Applicable law — Dispute resolution
13.1 These T&Cs will be executed and interpreted in accordance with French law.
13.2 In the event of a dispute that may arise in connection with these T&Cs, their interpretation and consequences or with acts complementing or modifying them, the User will contact Efalia in order to try to obtain an amicable solution.
13.3 Any complaint to Efalia must be formulated in writing.
